Terms of Service
Last updated: 7 November 2026
These terms apply when you use this website and when you work with Fadnix Solutions(“Fadnix”, “we”, “us”). By using the site or accepting a quote from us, you agree to them. If you have a signed proposal or agreement with us and it says something different, the signed document wins.
Using this website
You're welcome to browse, share and link to our pages. Please don't:
- use the site for anything unlawful, or to send spam or harmful code
- try to break, overload or get around the site's security, including its forms and spam checks
- copy large parts of the site, or scrape it in bulk, without our permission
- pretend to be someone else when contacting us
The content, design, logos and case studies on this site belong to us or to the clients and partners who let us show them. Client names and trademarks belong to their owners.
Information on the site
Our pages describe our services in general terms. Results in our case studies come from specific projects and aren't a promise of the same results for you. The cost calculator gives an estimated range, not an offer; your price and timeline are confirmed in a written quote.
Quotes and project agreements
After a discovery call, we send a written quote or proposal setting out the scope, deliverables, price, payment schedule and timeline. A project starts once you accept it in writing and pay the first payment. Anything not described in the agreed scope is outside the project and is quoted separately.
Payments
- Projects are paid in milestones, usually a deposit, then payments at stages such as design approval and launch. Your quote sets out the exact schedule.
- Monthly services, such as marketing management, e-commerce management and maintenance plans, are billed monthly in advance.
- Invoices are due by the date shown on them. If a payment is overdue, we may pause work until it's settled, and agreed timelines move accordingly.
- Third-party costs, such as domains, hosting, software subscriptions, plugins, stock media, app store fees and advertising spend, are paid by you, either directly to the provider or passed on at cost with your approval. Ad spend is paid directly to platforms like Google and Meta.
Your part
Projects go faster when we have what we need. You agree to provide content, access, approvals and feedback in reasonable time, and confirm you have the right to use any material you give us, such as text, images, logos and data. Delays in feedback or materials can move the timeline.
Revisions, changes and refunds
Every deliverable includes two rounds of revisions. Our revision policy explains what a round includes and how extra changes are handled. Our refund policy explains cancellations and refunds. Both form part of these terms.
Ownership
- Once you've paid in full, you own the deliverables we create specifically for you, such as designs, code, content and videos. Where possible, we build in accounts that you own from the start.
- Third-party and open-source components, fonts, plugins and stock media stay under their own licences, which we'll point out where they matter.
- We keep the rights to our general know-how and to tools, templates and code we created before or outside your project, and you get a permanent licence to use any of them included in your deliverables.
- We may show completed work in our portfolio and case studies. If you'd rather we didn't, or your project is under an NDA, tell us and we won't.
Confidentiality
We keep your business information, data and plans confidential and use them only to deliver your project, and we ask you to treat our proposals and pricing the same way. We're happy to sign a mutual NDA before you share anything sensitive. How we handle personal data is explained in our privacy policy.
Our commitment, and its limits
We do our work with reasonable skill and care. If something we built doesn't work as described in the agreed scope and you tell us within 30 days of delivery, we'll fix it at no extra cost.
We can't guarantee specific business results, such as search rankings, lead numbers, sales, ad performance or approval by app stores and ad platforms, because they depend on factors outside our control. We're also not responsible for outages, policy changes or price changes by third-party platforms and tools.
Limitation of liability
To the extent the law allows, we aren't liable for indirect or consequential losses, such as lost profits, revenue, data or business opportunities. Our total liability for any project is limited to the fees you paid us for that project in the three months before the claim. Nothing in these terms limits liability that can't be limited by law, or any rights you have as a consumer where you live.
Ending a project
Either of us can end a project in writing if the other seriously breaks these terms or the project agreement and doesn't fix it within 14 days of being told. What happens to payments when a project ends early is set out in our refund policy.
Governing law
These terms are governed by the laws of the State of Texas, USA. Any dispute will be handled by the state or federal courts located in Travis County, Texas, unless the law of your country gives you the right to bring a claim where you live. Before going to court, we'll both try in good faith to resolve the matter by talking it through.
Changes to these terms
We may update these terms and will revise the date at the top when we do. Changes don't affect projects already under way unless we both agree in writing.
